A marriage contract is a legal agreement between two people who are planning to get married and build a family. It is used in determining which property will remain to each spouse that the marriage ends. However, some marriage contracts also include the commitments between the spouses in a marriage that they make to each other and conditions of the marriage. These contracts also determine the details of how children who were born before the marriage will be cared for in the event that the marriage ends.

 

A marriage contract can be signed before or after getting married. The former will come into effect on the day of the marriage. People under 18 years of age usually do this but they will need the court’s approval to sign a marriage contract, also their parents’ opinion about getting married. The latter will come into effect in the day they signed it. This ends a Matrimonial Regime that applied from the day they were married up to the day they signed the marriage contract. Therefore, their properties will now be partitioned or divided.

 

A marriage contract can also be changed any time if the spouses want. In addition, spouses also can sign a new marriage contract but they need anyone or a witness that is present in the spouses’ signing of their old marriage contract.

 

One of the advantages of signing a marriage contract is choosing a Matrimonial Regime. A Matrimonial Regime identifies how the spouses’ properties are properly cared while they are still married and at the end of it; for example, if they decide to divorce or if one of them dies.
